fiance visa
This relationship must be genuine so FIRST, fall in love with someone that loves you, and wants to marry you and build a life together.
AFTER that, NOT before, we can help you bring him or her to the United States.
The K1 visa, known as the fiancé visa is specifically for foreign nationals engaged with U.S. citizens allowing them to enter United States on a nonimmigrant visa to get married within 90 days of arrival. This process involves several key steps.
To qualify for a K1 visa, both partners must meet some crucial requirements:
- Genuine Relationship: You must prove that your relationship is genuine and not for immigration purposes. You must provide evidence of your relationship history, photos, communication records, travel itinerary, etc.
- Eligible U.S. Citizen Sponsor: The U.S. citizen must meet certain income requirements that demonstrates the ability to support the fiancé financially.
- In-Person Meeting: The couple must have met in person during the 2 years of applying for K1 Visa.
- Marriage Intent: You must demonstrate your intent to marry one another within 90 days of entering United States.
The Application Process
The K1 visa begins with the U.S citizen sponsor filing a Form I-129F, Petition for Alien Fiancé(e), with U.S. Citizenship and Immigration Services (USCIS).
The most important is to submit a thick package of forms, supporting documents, and prove that this is a genuine relationship. The happy outcome of success and final approval depends on our thorough, detailed, and quality of information provided by collecting and building a strong case to avoid delays, and denials.
U.S. Immigration Professionals will help you minimizing the stress and do it right from the beginning for you.
Once approved by USCIS, the petition will be forward to the National Visa Centre (NVC) and then to the U.S. embassy or consulate in the fiancé(e)’s home country.
The foreign fiancé(e) will be required to attend an interview at the U.S. embassy or consulate, where they must provide additional documents. The U.S. sponsor must send your partner the affidavit of support which we’ll prepare for you, along with financial evidence such as tax returns, proof of employment and asset proofs.
Your fiancé(e) collects the documents for the interview such as police clearance and will be subject to a thorough medical exam at a clinic appointed by the embassy or consulate. This must be done especially by the clinic the embassy appoints and no other. The results will be in some cases sent directly to the embassy/consulate or given to your fiancé in a sealed envelope.
The day of the interview a clerk will go over the checklist to confirm if all the documents are being provided.
We at US Immigration Professionals prepare for you a personalized detailed checklist to avoid delays.
Steps After Arrival in the U.S.
Once arrive in U.S., the couple must marry within 90 days. After the marriage:
- Adjustment of Status: Once married, the U.S. citizen can apply for a Green Card by filing Form I-485.
